1. Acceptance of Terms

Welcome to Puzzle Solver ("Service", "we", "us", or "our"), accessible at puzzlesolver.io. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Puzzle Solver provides an AI-powered service designed to assist users in solving various types of puzzles. This may involve analyzing user-uploaded images using Optical Character Recognition (OCR) and other AI technologies (potentially including services from Google Cloud and Mistral). The Service offers different tiers, including a free tier and paid subscription plans ("Pro Weekly", "Pro Monthly") with varying features and usage limits.

3. User Accounts

To access certain features of the Service, including paid subscriptions, you must register for an account. You can create an account using your email address and a password, or by using Google Sign-in. You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You must provide accurate and complete information when creating an account.

4. User Conduct and Responsibilities

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You agree not to upload any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable. You are solely responsible for the content you upload.

5. User Content (Image Uploads)

When you upload images or other content ("User Content") to the Service for puzzle solving, you retain ownership of your User Content. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content solely for the purpose of providing and improving the Service (e.g., processing the image via OCR, analyzing the puzzle). We will treat your User Content in accordance with our Privacy Policy. You represent and warrant that you have all the rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit.

6. Paid Subscriptions and Payments

We offer paid subscription plans ("Pro Weekly", "Pro Monthly") which provide enhanced features and usage limits compared to the free tier.

  • Billing: Subscriptions are billed on a recurring basis (weekly or monthly) through our third-party payment processor, PayPal. By purchasing a subscription, you authorize us (via PayPal) to charge your chosen payment method on a recurring basis until you cancel.
  • Fees: Subscription fees are specified on our pricing page and are subject to change. We will notify you in advance of any fee changes.
  • Cancellation: You may cancel your subscription at any time through your account settings or via PayPal. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of the billing period.
  • Refunds: Subscription payments are generally non-refundable. We do not provide refunds or credits for partially used subscription periods or unused services, unless required by law.
  • Taxes: You are responsible for any applicable taxes associated with your subscription purchase.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Puzzle Solver and its licensors. The Service is protected by copyright, trademark, and other laws of both the South Africa and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

Our Service relies on third-party services, including but not limited to Supabase (for backend infrastructure and authentication), PayPal (for payment processing), Google Cloud (for authentication AI services and potentially other APIs), and Mistral (potentially for AI features). Your use of these third-party services may be subject to their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

9. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the operation or availability of the Service, or the information, content, or materials included therein. While we strive for accuracy, we do not guarantee that puzzle solutions provided by the Service will always be correct or complete.

To the fullest extent permitted by applicable law, Puzzle Solver, its affiliates, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or delete your account if such functionality is available.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
